Risk and Liability Disclaimer

Version 1.1, effective 2026-10-12.

This page explains who is responsible for what when you rent through sewa.rent, and the risks that come with boats, motorbikes, cars, machines and stays. You accept it, together with the Terms of Service (the “Terms”), when you tick the box at sign-up or on a booking request. Owners also accept it as part of the Owner Partner Agreement.

What this page never limits

Nothing on this page or in our Terms limits or excludes:

  • your rights as a consumer under Indonesian law that cannot be waived, including Law No. 8 of 1999 on Consumer Protection;
  • our liability for death or personal injury caused by our own negligence;
  • our liability for our own gross negligence, wilful misconduct or fraud;
  • our duties as an electronic marketplace operator (PPMSE) under Government Regulation No. 80 of 2019 on Trade through Electronic Systems (for example handling complaints, protecting your data and removing illegal content);
  • the Owner’s responsibility for the rental it provides, or your right to claim against the Owner or to go to a consumer dispute settlement body (BPSK) or a court.

In short

  • Sewa Rent is an online marketplace. The Owner named on the listing provides the rental and answers for it: the boat, vehicle, machine or room, the crew, driver or operator, the safety equipment, the permits and the insurance.
  • The rental contract is between you and the Owner. You pay the Owner directly, on the Owner’s payment terms. Guests pay Sewa Rent nothing; the Owner pays us a commission.
  • We answer for our own work as a marketplace: running the site, checking listings before they go live, handling complaints and acting on safety reports. We do not own, operate, crew, drive, inspect or insure anything listed.
  • Boats, diving and snorkelling, motorbikes, cars and heavy machines carry real risks, including drowning, crashes, injury and death. These risks exist even when everyone is careful. You decide whether an activity suits you, and you answer for your own licence, fitness, sobriety and conduct.
  • In an emergency in Indonesia call 112. Sewa Rent support is not an emergency service.

1. Who this applies to

  1. This page applies to everyone who uses sewa.rent (the “Platform”): guests who send booking requests (“Guests”), owners and operators who list items or services (“Owners”), and the people who travel, ride or work with them.
  2. A Guest who books for other people (family, friends, a group, employees) must share this page with them. The adult who books is responsible for any children in the party.
  3. “Rental” and “item” also cover services offered on the Platform, such as boat trips, drivers, guides, tours, flights and machines with an operator.

2. Our role and the Owner’s role

  1. Sewa Rent operates an electronic marketplace (in Indonesian law, a penyelenggara perdagangan melalui sistem elektronik, PPMSE). We let Guests find listings and send free booking requests, and let Owners answer them.
  2. The Owner is the business that provides the rental to the Guest. The Owner’s name is shown on the listing and in the booking confirmation. The rental contract is made between the Guest and the Owner only.
  3. Sewa Rent is not the lessor, charterer, carrier, transport company, tour operator, travel agent, captain or operator of anything listed. We do not employ or direct any captain, crew member, driver, guide or machine operator. We do not sell trips or rentals in our own name. We are not an insurer and we do not sell or arrange insurance.
  4. We do not take payments from Guests and we do not hold deposits.

3. What we do, and answer for

We are responsible for our own duties as a marketplace. We:

  1. run the Platform with reasonable care and fix errors we are told about;
  2. check each new listing before it goes live. This is a quick check of the content (category, photos, contact rules, prohibited items). It is not an inspection of the item;
  3. offer optional verification badges (section 5);
  4. receive complaints and safety reports at support@sewa.rent or WhatsApp +62 877-7783-7084. We confirm receipt within 24 hours and give an answer or a plan within 5 business days. When a report shows a safety risk, we can pause the listing while we look into it;
  5. remove illegal content when we learn of it, and cooperate with the authorities;
  6. protect your personal data as described in our Privacy Policy.

4. Listings, search results and reviews

  1. Listing text, photos, prices, specifications, licences, insurance status and safety equipment are statements made by the Owner. We do not check them for accuracy, except as described in section 5 (verification badges).
  2. The order of search results and labels such as “popular” are not recommendations.
  3. Reviews are the personal opinions of other users. We check them for abuse, not for truth. A good rating is not a safety assessment.

5. “Verified owner” and “Verified listing”

  1. Verified owner means that, on the date shown, our operator checked the identity of the person or business behind the account (by video call on WhatsApp, in person, or from documents) and confirmed their WhatsApp number.
  2. Verified listing means that, on the date shown, our operator checked that the boat, vehicle, machine or place exists and matches the photos.
  3. A badge is not an inspection of the item’s condition, a seaworthiness or roadworthiness certificate, proof of licences, permits or insurance, a guarantee of the service, or ongoing monitoring. Documents can expire and conditions can change after the check.

6. Risks you accept knowingly

  1. Many rentals on the Platform involve activities that are risky by nature. Even a well-kept item used with care can be in an accident. Weather, sea and roads in Indonesia can change quickly, medical help can be far away (for example around Komodo or Nusa Penida), and local rules may differ from those at home.
  2. By sending a booking request you confirm that you understand the risks of the activity, that you have thought about whether it suits you and the people with you, and that you choose to take part.
  3. This acknowledgement does not release the Owner, the crew or anyone else from responsibility for their own fault, and it does not take away any right the law gives you.

7. Boats, sea trips, snorkelling and diving

  1. Risks include rough sea, strong currents, sudden weather changes, collisions, engine failure, capsizing and sinking, falling overboard, injuries when boarding or on the reef, sunburn, dehydration, seasickness, marine life, slow rescue in remote areas, and drowning or death.
  2. The captain is in command on board. The Owner must provide a registered, seaworthy boat, a licensed captain and enough crew, a life jacket for every person on board (including child sizes when children are accepted), the safety and communication equipment required by law, and the sailing clearance needed for the trip. Dives must be led by certified professionals.
  3. As a Guest you must: tell the crew before departure about anyone who cannot swim well, and about medical conditions or pregnancy; wear a life jacket whenever the crew says so; follow the captain and crew at all times; dive only within your certification and medical fitness; and not drink alcohol or take drugs before swimming, snorkelling or diving.

8. Motorbikes, scooters and cars

  1. Road accidents are one of the most common causes of serious injury and death among visitors to Indonesia. Traffic is dense, roads can be steep, wet, sandy or damaged, and other road users may not follow the rules.
  2. You may ride or drive only with a valid licence for the category. Motorbikes: an Indonesian SIM C (up to 250 cc), SIM C I (over 250 cc up to 500 cc) or SIM C II (over 500 cc), or your home licence together with an International Driving Permit (IDP) valid for motorcycles. Cars: an Indonesian SIM A, or your home licence together with an IDP valid for cars. Indonesia recognises IDPs issued under the 1968 Vienna Convention on Road Traffic (Police Regulation No. 5 of 2021, Article 3); if your country issues IDPs only under the 1949 Geneva Convention, check with your issuing body and the Owner before you travel. An IDP is valid only together with your home licence and only while you are a visitor; residents (KITAS or KITAP holders) need an Indonesian SIM. Visitors from ASEAN countries may use their national licence (ASEAN agreement of 1985) if it is in English or carries a certified English translation. Without the right licence you break the law, and many insurance policies will not pay.
  3. Wear a fastened helmet, and make sure your passenger does too. Use seat belts and child seats in cars. Do not carry more people or luggage than the vehicle is built for. Never ride or drive after drinking alcohol or using drugs. Traffic fines and police checks are your own responsibility.
  4. Check the brakes, lights, tyres and helmet before you leave. If the vehicle does not seem in order, do not take it, and tell the Owner and us.
  5. The Owner must provide a roadworthy vehicle with valid registration (STNK), current tax, and the helmets stated in the listing. When a driver comes with the car, the driver is the Owner’s staff and the Owner answers for the driver.
  6. After an accident, call for help, make a police report when required, and tell the Owner.

9. Heavy equipment and machines

  1. Excavators, loaders, cranes, generators and other machines can cause serious injury, death and damage to property, cables, pipes and the ground.
  2. Only a qualified operator holding any licence the law requires may operate a machine. If the Owner provides the operator, the Owner answers for the operator and for the machine’s condition and inspections. If you provide the operator, you answer for that operator.
  3. You are responsible for the work site: permits for the works, ground conditions, underground cables and pipes, fencing, keeping people out of the working area, and transport permits on public roads where needed. We do not assess whether a machine suits a job.

10. Villas, rooms and kos

  1. The Owner answers for the property: building, electrical, gas and fire safety, pools (fencing and warnings), balconies and stairs, working locks, the permits for the type of accommodation, and registering foreign guests where the law requires it. The Owner should tell you about hazards such as steep stairs, a pool without a lifeguard, or animals.
  2. You are responsible for your belongings, your visitors and following the house rules. Take special care with children around pools, water and balconies.

11. Drivers, guides, tours and flights

Drivers, guides, tour and activity providers and aircraft operators on the Platform work for themselves or for the Owner, not for Sewa Rent. They answer for their own licences, permits, vehicles, aircraft, equipment, insurance and the safety of their service. Volcano treks, waterfalls, cliffs and remote areas carry their own risks: follow your guide and the local authorities.

12. Weather and whether to go

The Owner, the captain or the harbour authority decides whether it is safe to sail, ride or work, and may cancel, shorten or change a trip because of the weather or the sea. Sewa Rent makes no weather assessment. What happens to your money then follows the Owner’s cancellation policy and our Weather and Sea Policy.

13. What the Owner answers for

The Owner is responsible to the Guest and under the law for:

  1. the safety, condition, maintenance and legality of every item and service listed;
  2. the safety equipment the activity needs and the law requires, such as life jackets, helmets, fire extinguishers and first-aid kits;
  3. registration, seaworthiness, roadworthiness or airworthiness, and current tax and inspection documents;
  4. all licences, permits and business registrations needed to offer the rental;
  5. the qualifications, licences, fitness and conduct of every captain, crew member, driver, guide and operator the Owner provides;
  6. checking the Guest’s licence where required, and refusing a handover to anyone who is not fit, sober or licensed to use the item;
  7. insurance required by law, and telling the Guest truthfully what is and is not insured;
  8. a safety briefing that suits the activity;
  9. reporting accidents to the authorities and to us.

14. What the Guest answers for

The Guest is responsible for:

  1. deciding whether an activity suits them and the people with them, taking into account experience, health, age, and swimming or riding ability;
  2. holding and carrying the licence or certification the activity requires;
  3. checking the item before use and refusing it if it does not seem in order;
  4. following the safety instructions of the Owner, captain, crew, driver and guide;
  5. obeying the law, including traffic and maritime rules, and never using an item after drinking alcohol or using drugs;
  6. the people they bring, including children, who must be supervised at all times and may never operate a vehicle, boat or machine;
  7. their own belongings.

15. Insurance

  1. Sewa Rent provides no insurance and no “protection” product of any kind. A security deposit is not insurance.
  2. Whether an item is insured, and what the insurance covers, is decided by the Owner and stated on the listing. Ask the Owner before you book and get the details in writing.
  3. We strongly recommend travel insurance that covers medical treatment and medical evacuation, and that covers the activity you plan (for example riding a motorbike, diving or water sports). Check the exclusions: many policies do not pay if you ride without a valid licence or helmet, dive beyond your certification, or were drinking.

16. The limits of our responsibility

  1. Subject to “What this page never limits” at the top of this page, Sewa Rent is not liable for death, injury, illness, damage, loss, theft, fines, delay or cancellation to the extent they are caused by an Owner, a Guest or another third party, by the condition of an item or service, or by weather, the sea or other events outside our control. We remain liable to the extent such loss is caused by our own failure to carry out our duties as a marketplace (section 3).
  2. Where we are liable to a Guest, and the law allows a limit, our total liability for one booking is the greater of IDR 5,000,000 and the commission Sewa Rent receives for that booking. This limit never applies to the matters listed under “What this page never limits”. The Terms of Service (section 11) say the same. Towards Owners (business users) the limit is set in the Owner Partner Agreement, section 14. Towards Owners (business users) the limit is set in the Owner Partner Agreement, section 14. Towards Owners (business users) the limit is set in the Owner Partner Agreement, section 14.

17. Disputes about a rental

  1. Disputes about a rental, including damage, injury, deposits and refunds, are between the Guest and the Owner under their rental contract and the law.
  2. We can help: share the other side’s contact details, keep a record of the booking and the messages, and try to mediate. Our view is not binding, and we cannot order anyone to pay or refund.
  3. Nothing on this page stops you from bringing a claim against the Owner, against us for our own fault, or before a consumer dispute settlement body (BPSK) or the competent court, including the court where you live if you are a consumer.
  4. Owners must not ask Guests to sign any waiver that takes away rights the law gives them.

18. Compensation for claims you cause

  1. An Owner will compensate Sewa Rent for claims, losses and costs (including reasonable legal costs) that Guests, passengers, crew, authorities or other people bring against Sewa Rent because of the Owner’s items, services, staff, crew, drivers or operators, missing or lapsed licences, permits or insurance, or the Owner’s breach of the law or of the Owner Partner Agreement. Details are in the Owner Partner Agreement.
  2. A Guest will compensate Sewa Rent only for claims that other people bring against Sewa Rent because of the Guest’s own breach of the law or of the Terms of Service, or the Guest’s own content.
  3. Neither obligation applies to the extent a loss was caused by Sewa Rent.

19. Emergencies and safety reports

In an emergency, get help first. Sewa Rent support is not an emergency service. Emergency numbers in Indonesia:

  • 112 — general emergency number
  • 110 — police
  • 118 or 119 — ambulance and medical emergency
  • 113 — fire brigade
  • 115 — search and rescue at sea and on land (Basarnas)
  1. After an emergency, tell the Owner, and write to us on WhatsApp +62 877-7783-7084 or at support@sewa.rent with the booking number.
  2. Please also report anything unsafe you notice about a listing, an item or an Owner, even if nothing happened. We take safety reports seriously and can pause a listing.

20. Services of other companies

WhatsApp, maps, translation tools, payment apps and other services you use alongside the Platform are provided by other companies under their own terms. We are not responsible for them.

21. Changes, language, law and contact

  1. We may update this page. The version and date are shown at the top. When the meaning changes, we will tell registered users in advance and ask you to accept the new version before your next booking request. A request you already sent stays under the version you accepted then.
  2. This page is published in English and Indonesian. For consumers in Indonesia the Indonesian version is binding. Translations into other languages are for convenience only; if they differ, the English and Indonesian versions prevail.
  3. If any part of this page cannot be enforced, it applies to the extent the law allows, and the rest stays in force.
  4. This page is governed by the law of the Republic of Indonesia.
